Book Description
The primary concern of every Finance Minister is to alleviate the catastrophic bad debts on the economy of the Country. Various Committees set up by the Government to address this problem, and it was with this object that Debt Recovery Laws were framed. These laws provide much more simplified and uncomplicated methods for adjudication and recovery of bad debts.
Though, these measures worked upto a certain extent, majority of Banks and Financial Institutions are still reeling under large amounts of bad debts. To convert bad debts in performing assets, Debt Recovery Laws must be rigorously and vigorously employed. The objectives are certainly laudable which aim at, specifically to deal with "non-performing assets' into 'performing assets'. Some stringent measures are also there in the laws to make them more effective. One of the Section mandates to recover bad debts to Banks and other Financial Institutions - that no appeal shall lie with Debt Recovery Tribunal unless the borrower deposits 75% of the amount due to Banks or Financial Institutions.
Justice Srivastava's Commentaries on Securatisation & Debts Recovery Laws and other related laws was first published in the year 2000 and was well received and appreciated by the readers.
