Description
The new edition of this critical and comprehensive study of the Indian Penal Code has been extensively revised and updated. Cases that have upheld the concept of right to compensation to the victims of rape, even to a foreign national; accountability of public servants and ministers for arbitrary exercise of discretionary powers; personal liability for contempt of court; absolute liability against environmental crimes; State accountability for police crime, custodial death, atrocities on women and human rights violations; manufacturer's liability for criminal negligence etc., have been elaborately discussed in the book. Crimes against women, bride burning, dowry death, sexual harassment at workplace, abolition of death sentence, concept of rarest of rare cases, world wide trend to legalize Physician assisted suicide (PAS), euthanasia and mercy killing, right to die vis-a-vis right not to die; right to life of the unborn vis-a-vis women's right to privacy to seek termination of pregnancy, etc., are some of the fascinating topics that form part of the book.
The question of desirability of death sentence for a rapist in the light of a great demand by a large section of the society and women organisations in particular has been critically examined in the context of American cases prohibiting death sentence for rape, being disproportionate, cruel and unusual punishment contrary to the VIIIth Amendment to the US Constitution. Rape under English law, which has been drastically amended and completely changed vide section 142 of the Criminal Justice and Public Order Act, 1994, indecent assault, incest, etc.; have been elaborately discussed. For instance, 'rape' under English law is no more confined to a woman. A man can also be subjected to rape.
Recent developments in the field of cyber crimes vide Information Technology Act, 2000 and a bar on character assassination of a rape prosecutrix in cross-examination vide Indian Evidence (Amendment) Act, 2002 (3 of 2003) have also been included.
Apart from Indian decisions, leading and illustrative cases decided by the courts of the United States of America, Northern Ireland, Germany, South Africa, Australia, Canada, Sri Lanka, Pakistan, Myanmar, Bangladesh, Malaysia, Singapore and European countries, etc., have been discussed so that readers can grasp the intricate problems of law without difficulty.
