Description
By its long journey for more than a century B.B. Mitra's the Limitation Act provides an authoritative coverage of the entire law on the subject.
The object of the statute is to make the litigant public vigilant in pursuing its remedy and also to prevent harassment to the opposite party by bringing stale claims before the legal forum. It primarily bars a remedy for a litigant but does not bar a right, except when the law of prescription, extinguishes the remedy as well as the right. In this view, the Limitation Act is both a law of limitation and of prescription.
However, in certain circumstances, the litigant gets exemption and extension of the period of limitation as provided in the sections 4 to 24 of the Act. These provisions, specially the provisions relating to condonation of delay in filing application, appeal and applications for revision and review under section 5 of the Limitation Act have been highlighted. For the first time, the benefits of section 5 of the Limitation Act have been extended to applications made under any special statute provided that such proceedings are initiated in a court of law and not in any tribunal or before any statutory authority.
Each section as well as every Article of the Schedule to the Limitation Act has been thoroughly discussed in the light of the latest law as developments brought about by the 1999 and 2002 amendments to the Code of Civil Procedure and also by judicial pronouncements of the Supreme Court and of different High Courts of India.
While discussing the law the present author has been very exhaustive in dealing with such sensitive areas of the law including acknowledgment, adverse possession, cause of action, compensation, easement, execution of decree, injunction, legal disability, pre-emption, specific performance of contract, etc.
